On July 5, 2005, a road construction employee was working in a coned off, white painted center median in the westbound lanes of Oceanside Boulevard in Oceanside, California. A motorist, heading westbound on Oceanside Blvd. spilled a drink onto herself, causing her to drive onto the raised center median and hit the road construction worker. As a result, the road construction worker was pinned against construction machinery, and underwent a series of surgeries which resulted in an above the knee amputation. Based upon Mitchell / Gilleon’s arguments, the court awarded the worker $ 5,000,000.
