As a result of this tragic event, a developmentally delayed man suffered brain injury and fractures to the skull, face, pelvis, ankle, femur, and hand. The injured patient also suffered multiple surgeries including the need for a right knee replacement and an extensive recovery process.

On August 18, 2005, a developmentally disabled man, age 37, was admitted to Scripps Memorial Hospital in Hillcrest, California because of a prolonged seizure caused by epilepsy. While at the hospital and under its care and supervision, the developmentally disabled man got out of bed and began to pound on the window. Because of the hospital’s failure to maintain the window’s locking hardware, the window popped open, and the developmentally disabled man climbed out the window in his room, falling from the sixth floor to a balcony below.

The developmentally disabled man sought legal assistance from Mitchell / Gilleon and as a result of their efforts, he was awarded a jury verdict of $1,074,102.
